This Acceptable Use Policy (“Policy”) applies to everyone who uses Veliu’s Services, the Partner Program tools or veliu.com (“you”). It is part of the Master Subscription Agreement published at veliu.com/terms (the “Agreement”) and of the Partner Program Agreement, and capitalised terms have the meaning given there. For a visitor of veliu.com who holds no agreement with Veliu, this Policy states the conditions of use of the website.

Uses excluded

You do not use the Services, the Partner Program tools or veliu.com:

(a) in breach of applicable law, including consumer, advertising, competition, data protection and export laws;

(b) for fraud or deception, including fake reviews, false scarcity, hidden fees or any manipulation of visitors in what the Brand Agent says or shows;

(c) to harm or exploit minors;

(d) to store, publish or transmit content that is defamatory, harassing, hateful or obscene, or that infringes intellectual property, privacy or other rights of a person;

(e) to send unsolicited messages, or to collect personal data of visitors beyond what the DPA and your own notices cover;

(f) to compromise or test the security of Veliu’s systems, or anyone else’s, without written authorisation, including probing, scanning, load testing, or circumventing rate limits, keys or access controls;

(g) to impersonate Veliu, a brand, a partner or any person, or to present the Brand Agent as a person;

(h) to build a competing product, to train an artificial-intelligence model other than the Brand Agent on Service Content, or to resell access to the Services, as Section 2.4 of the Agreement sets out;

(i) in a way that interferes with other customers’ use of the Services, or that Veliu reasonably determines exposes Veliu, its customers or their visitors to harm or liability.

Content you publish through the Services

The Sources you connect are your content, and the Outputs the Brand Agent publishes on your website and on the gateway endpoints are Service Content; you are responsible for the Sources and for the configuration of the Brand Agent, as Section 3 of the Brand Agent Terms and Section 5 of the Agreement set out. Veliu may remove or disable content that breaches this Policy or the law, after notice to you where practicable.

Reporting a violation or an infringement

3.1 How to report. Anyone may report a breach of this Policy or an infringement of their rights by email to legal@veliu.com, or by post to Veliu Limited, attention Legal, 31-36 Ormond Quay Upper, Suite 4.01 Ormond Building, D07 F6DC, Dublin 7, Ireland. A report identifies the content (address of the page, screenshot, date), explains the breach or the right infringed (for intellectual property, the work concerned and the reporter’s title to it), says what the reporter has tried with the brand concerned, and gives the reporter’s contact details and a statement that the report is made in good faith. Veliu forwards the reporter’s contact details to the customer concerned only where resolving the report needs them, for example for an intellectual property claim; a reporter who objects says so, and Veliu assesses the report without them where it can.

3.2 What Veliu does. Veliu acknowledges a report within two (2) Business Days, forwards it to the customer concerned, with the reporter’s contact details where they are needed to resolve it, and investigates. Veliu may remove or disable the content, suspend the account under Section 6 of the Agreement or of the Partner Program Agreement, or terminate it under Section 10.2 of the Agreement or Section 10.4 of the Partner Program Agreement. Veliu informs the reporter of the outcome. Where the content sits on the customer’s own website, Veliu may also direct the reporter to the customer.

Consequences

A breach of this Policy is a breach of the Agreement or of the Partner Program Agreement. Veliu may remove or disable content, suspend the account under Section 6 of the Agreement or of the Partner Program Agreement, terminate it under Section 10.2 of the Agreement or Section 10.4 of the Partner Program Agreement, and report unlawful conduct to the competent authorities. A “repeat infringer” is a customer or partner that has received two (2) notices from Veliu of breaches of this Policy within twelve (12) months and breaches it again. Amounts due remain due as Section 10.4(b) of the Agreement and Section 10.5 of the Partner Program Agreement provide.

Changes

Veliu may update this Policy with at least thirty (30) days’ notice on veliu.com or by email. A change that adds obligations for a customer under the Agreement takes effect under Section 18.6 of the Agreement, unless the law requires it sooner, in which case it takes effect on the date the law requires.
